Terms of Service

1. About Your Pauza

Your Pauza is a digital platform and project of LivingX LLC focused on menopause, midlife wellbeing, education, AI-assisted guidance, care navigation, professional discovery, and related resources. These Terms & Conditions ("Terms") govern your access to and use of YourPauza.com and related Your Pauza services.

Unless expressly stated otherwise, LivingX LLC is not acting as your physician, healthcare provider, pharmacy, therapist, dietitian, attorney, or other licensed professional.

2. Eligibility

You must be at least 18 years old to use personalized health questionnaires, health-related AI features, or account-based health functionality. By using those features, you represent that you meet this age requirement and have legal capacity to agree to these Terms.

3. Educational Purpose — Not Medical Care

Your Pauza provides educational information, digital tools, AI-assisted guidance, care-navigation resources, and information about independent professionals. Your Pauza does not diagnose disease, prescribe medication, establish a treatment plan, or replace individualized evaluation by a qualified healthcare professional.

Your use of Your Pauza does not by itself create a doctor-patient, therapist-patient, pharmacist-patient, attorney-client, or other licensed professional relationship with LivingX LLC.

4. Artificial Intelligence

Certain Your Pauza features may be generated or supported by artificial intelligence. AI systems can misunderstand context and may produce inaccurate, incomplete, outdated, or misleading information.

• Do not use an AI response as the sole basis for diagnosing a condition.
• Do not start, stop, or change medication based solely on an AI response.
• Do not delay professional or emergency care because of an AI response.
• Use AI outputs as educational support and, where appropriate, as material to discuss with a qualified professional.

The Medical & AI Disclaimer is incorporated into these Terms by reference.

5. Emergencies

Your Pauza is not an emergency service. If you believe you may be experiencing a medical emergency, severe or rapidly worsening symptoms, or an immediate danger to yourself or another person, seek emergency care. In the United States, call 911 when appropriate.

6. Professional and Provider Information

Your Pauza may provide information about physicians, clinicians, therapists, coaches, nutrition professionals, wellness providers, or other professionals. Unless expressly stated otherwise, such professionals are independent from LivingX LLC.

• Inclusion on Your Pauza is not a guarantee or endorsement of a professional or outcome.
• LivingX LLC does not control an independent professional’s clinical or professional judgment.
• You should independently verify licensing, credentials, availability, pricing, insurance participation, and suitability.
• Any professional relationship is formed separately between you and the professional under that professional’s own terms and policies.

7. Accounts and Security

If an account is required, you agree to provide accurate information and maintain the confidentiality of your credentials. You must promptly notify LivingX LLC if you believe your account has been compromised. You are responsible for activity conducted through your account to the extent permitted by law.

8. Acceptable Use

You may not use Your Pauza to:

• Violate applicable law or the rights of another person.
• Attempt unauthorized access to systems, accounts, data, or security controls.
• Interfere with the operation, integrity, or security of Your Pauza.
• Upload malware, harmful code, or content designed to disrupt services.
• Impersonate another person or misrepresent your identity or authority.
• Harass, threaten, exploit, or harm another person.
• Systematically scrape, copy, or extract protected content except as expressly permitted.
• Reverse engineer protected technology except to the limited extent applicable law expressly permits.
• Use AI features to facilitate unlawful, fraudulent, abusive, or harmful conduct.

9. Intellectual Property

Your Pauza, LivingX, associated names and branding, website design, original content, software, AI configurations, graphics, and other proprietary materials are owned by or licensed to LivingX LLC unless otherwise identified. You receive a limited, personal, non-exclusive, non-transferable, revocable right to use Your Pauza for lawful personal purposes. No ownership rights are transferred to you.

10. User Submissions and Feedback

If Your Pauza allows you to submit content intended for publication, you retain ownership of your original content but grant LivingX LLC a non-exclusive, worldwide, royalty-free license to host, reproduce, display, and use that content as reasonably necessary to provide and promote the applicable service, subject to applicable privacy law.

Do not publicly post confidential medical information or personal information about another person without appropriate authorization. If you voluntarily provide product feedback or suggestions, LivingX LLC may use that feedback without obligation to compensate you, provided we do not publicly identify you without permission.

11. Privacy and Consumer Health Data

Your use of Your Pauza is also subject to the Privacy Policy and, where applicable, the Consumer Health Data Privacy Policy and Health Data & AI Consent. Acceptance of these Terms is not intended to substitute for a separate consent that applicable law requires for sensitive or Consumer Health Data.

12. Third-Party Services and Links

Your Pauza may integrate with or link to third-party services. LivingX LLC does not control independent third-party services and is not responsible for their content, availability, products, security, privacy practices, or professional services. Your use of a third-party service may be governed by separate terms.

13. No Guarantee of Results

Individual health experiences and outcomes vary. LivingX LLC does not guarantee that Your Pauza will improve symptoms, identify every possible health issue, result in a diagnosis, produce successful treatment, locate a suitable professional, or achieve any particular personal or health outcome.

14. Changes to the Service

We may add, modify, suspend, restrict, replace, or discontinue features. We do not guarantee uninterrupted, error-free, or permanently available access to Your Pauza.

15. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOUR PAUZA IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. LIVINGX LLC DISCLAIMS WARRANTIES NOT EXPRESSLY PROVIDED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT INFORMATION OR AI OUTPUTS WILL BE ACCURATE, COMPLETE, CURRENT, OR SUITABLE FOR YOUR PARTICULAR CIRCUMSTANCES.

Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIVINGX LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATING TO YOUR PAUZA.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF LIVINGX LLC ARISING FROM OR RELATING TO YOUR PAUZA WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID DIRECTLY TO LIVINGX LLC FOR YOUR PAUZA SERVICES DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) USD 100.

These limitations do not apply to liability that cannot legally be limited or excluded.

17. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless LivingX LLC and its officers, employees, and contractors from third-party claims, liabilities, damages, and reasonable costs arising from your unlawful use of Your Pauza, your material violation of these Terms, or content you submit in violation of another person’s rights. This obligation does not apply to the extent a claim results from LivingX LLC’s own unlawful conduct.

18. Suspension and Termination

We may suspend or terminate access when reasonably necessary to address a material violation of these Terms, fraud, abuse, security threats, legal requirements, or risks to users or the service. You may stop using Your Pauza at any time.

19. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise. To the extent a dispute is not subject to a legally required alternative forum, the parties consent to jurisdiction in the state and federal courts serving Collin County, Texas, where permitted by law.

20. Changes to These Terms

We may update these Terms as Your Pauza evolves. Material changes will be communicated when required by law. Continued use after updated Terms become effective constitutes acceptance where legally permitted.

21. General Provisions

If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect and the unenforceable provision will be interpreted or modified to the minimum extent necessary to make it enforceable where permitted. Our failure to enforce a provision is not a waiver. These Terms, together with incorporated policies and any additional terms expressly presented for a feature, constitute the agreement between you and LivingX LLC concerning Your Pauza.
